Data Submission Agreement

Please read this agreement carefully before submitting any data to Data Cooking Pty Ltd.

1. Your Authority to Share Data

By submitting data to us, you confirm that:

• You are legally authorised to share this data
• You own the data or have obtained necessary permissions from data owners
• The data does not violate any confidentiality agreements, privacy laws, or third-party rights
• If the data includes personal information about others, you have obtained appropriate consent

2. How We Handle Your Data

2.1 Confidentiality

We treat all submitted data as confidential business information. We will:

• Use your data solely for the purpose of delivering agreed services
• Implement appropriate security measures to protect your data
• Not share your data with third parties without your explicit consent (except as required by law or by trusted service providers under confidentiality obligations)

2.2 Data Privacy

Our handling of your data complies with our Privacy Policy and the Privacy Act 1988 (Cth). If your data includes personal information, we will process it in accordance with the Australian Privacy Principles.

2.3 Data Storage

Your data may be stored on secure cloud platforms. Any system credentials you provide will be stored using Keeper Security or equivalent secure password management tools.

3. Security and Risk

3.1 Our Security Measures

We implement industry-standard security measures including:

• Encrypted data transmission and storage
• Access controls and authentication
• Secure credential management
• Regular security assessments

3.2 Limitation of Liability

While we take data security seriously, you acknowledge that:

• No system is completely secure against all possible threats
• Data Cooking Co cannot be held liable for unauthorised access, disclosure, or use of data resulting from circumstances beyond our reasonable control
• You assume responsibility for ensuring submitted data does not violate your own contractual, legal, or ethical obligations

4. Data Usage and Disclaimers

4.1 Analysis and Recommendations

We will analyse submitted data and provide recommendations based on our professional judgment. However:

• We make no guarantees about specific business outcomes or results
• We do not warrant the accuracy, completeness, or suitability of data for any particular purpose
• Final business decisions based on our analysis remain your responsibility

4.2 No Endorsement

Submission of data does not constitute our endorsement, approval, or verification of:

• The accuracy or legality of the data
• Your business practices or methods
• Any third-party data sources you may have used

5. Your Obligations

When submitting data, you agree to:

• Comply with all applicable laws, including data protection and privacy laws
• Not submit data containing malware, viruses, or harmful code
• Not submit data that infringes intellectual property rights
• Provide accurate information about data sources and any limitations
• Notify us immediately if you become aware of any security concerns

6. Right to Refuse

We reserve the right to refuse or reject any data submission without providing a reason. We may decline to work with data that:

• Appears to violate laws or regulations
• Falls outside our areas of expertise
• Presents unacceptable risks or liability

7. Data Retention and Deletion

7.1 Retention Period

We retain submitted data for as long as necessary to provide services and comply with legal obligations (typically 7 years for tax and accounting purposes).

7.2 Data Return or Deletion

Upon request after project completion, we will:

• Return your data in a usable format, or
• Securely delete your data from our systems

Note: We may retain data if required by law or for legitimate business purposes (e.g., defending against legal claims).

8. Indemnification

You agree to indemnify and hold Data Cooking Co harmless from any claims, damages, losses, or expenses arising from:

• Your breach of this agreement
• Your submission of data you were not authorised to share
• Data that violates third-party rights or applicable laws

9. Changes to This Agreement

We may update this agreement from time to time. The "Last Updated" date at the top indicates when changes were made. Continued submission of data after changes constitutes acceptance of the updated agreement.
